What DUI Laws can be controversial in a state that is known for Drive-thru daiquiri joints?
Louisiana takes taking advantage of loopholes in open container laws to a new level. The local interpretation of Louisiana's open container laws is side stepped by serving the alcoholic beverages to drivers in large Styrofoam cups, then a piece of tape is place over the hole in the container you are hand a straw and away you drive. According to the law as long as the straw is not place in the hole you are good to drive. But, only in the Sugar State folk!

Another controversial current Louisiana drunk driving law states a court is supposed to confiscate and auction off your vehicle if you have multiple DWI convictions. However, some lawmakers are complaining because judges rarely enforce the law.
So in order to get prosecutors to demand that the law is enforced the Louisiana DWI Task Force wants to give the proceeds of the multiple offender vehicle auction to prosecutors. The new would give;
The lawmakers say that this will give prosecutors an incentive to press judges to enforce this kind of punishment.
Opponents say this would cost too much for police department who would have to seize and store these vehicles and bear the cost with no guarantee that the sale of the vehicle would cover these costs.
Also lawmakers are proposing a tough new law that would permanently revoke the license of a driver convicted of a 3rd DWI offense. One lawmaker was reported as saying; “people will never learn a lesson about drinking and driving unless there are harsh penalties and revoking their license is a harsh however it is very necessary.”
At the same time they want to increase the DUI penalty for driving when your license has been suspended by adding five years to the suspension.
Some Louisiana drivers say the law are getting too tough but about half think that anything done to keep drunk drivers off the road is justified.
HB 1274 this bill will make 2nd offense DWI offenders get a 45-day mandatory suspension and they will not be able to get a hardship license or an interlock device. And bills that increase jail time for multiple offenders were passed show that the drive thru daiquiri state is getting tough on driving under the influence.
