How does prior DUI offense affect in other states ?

DUI offenses are of two types namely Felony and Misdemeanors. For a misdemeanor offense there is fine of up to 1000 dollars and minimum jail term, while for a felony penalty of at least 1000 dollars and a confirmed prison term.

An offender with prior DUI charges should be prepared to face harsh consequences for repetition. If the offense is committed within 10 years from the date of first offense under DUI it considered to be a subsequent offense and treated more seriously and severely than the first one. The following regulations are common to all the states in the US.

  • The legal age for drinking is 21 in all states.
  • Administrative license revocation law has been introduced in 60% of the states where the driver refuses to take a breath test, this law enables the officer to seize your license.
  • The legal Blood Alcohol Concentration (BAC) limit is .08%.
  • All drivers under the age of 21 are denied any amount of alcohol in their system.

The lists of Penalties enforced on offenders with Prior DUI in all states are as follows.

  • Compulsory term in Jail.
  • Heavy fines.
  • License suspension for longer periods.
  • Difficulty is obtaining a hardship license to commute to the work place.
  • Any appeal to reduce punishments proves futile.
  • Enactment of the Habitual Violators Law in many states whereby the accused might loose his voting right, his right to own a weapon and permanent seizure of driving license for many years.

To get back the driving license the offender is expected to serve some time in DUI School, clear an assessment interview, they might be subjected to a medical test or a counseling program might be required to attend few meetings, additional insurance coverage before restoring their license which involves huge money. In some cases the offenders are made to face the victims face to face and listen to the pain and trauma they have under gone due to the accident.
